On said occasion, Prof. Didier Opertti Badan paid tribute to the 40th anniversary of the codification work of the OAS in Private International Law matters.

 

 

Relationship with the Organization of American States (OAS)


Last year ASADIP has achieved formal recognition at the general assembly of the OAS (Resolution AG / 2852 - XLIV-O / 14)

 

 

This year the Department of International Law of the OAS has actively participated in the event of ASADIP in Panama. In addition, a publication is being considered for next year and the organization of a joint event on Private International Law with the Inter-American Juridical Committee of the OAS and the American Society of International Law (ASIL) for April 2016.

 

ASADIP has been outstandingly represented in the OAS Rio de Janeiro Course with the participation of the Uruguayan Professor Veronica Ruiz, currently teaching at the University of Edinburgh in Scotland.

 

Also, in August 2015 in Rio de Janeiro it has been organized the "Meeting Between the American Juridical Committee and ASADIP regarding Private International Law", co-organized by the Federal University of Rio Grande do Sul, with the participation of prestigious jurists

Hague Conference on Private International Law


This year where approved the Hague Principles on the Applicable Law to International Commercial Contracts, for which two members of the ASADIP participated in the Working Group on its preparation.  The work was extensively discussed in several ASADIP fora.


In March 2015 took place the Fifth ASADIP Preparatory Meeting on the issues of the Meeting of General Affairs of the Hague Conference, coordinated by Professors Nadia de Araujo and Daniela Vargas. The topics covered were: a) The Brazilian proposal tourist consumer protection; b) The proposal on the Judgment's Project; c) The proposal on pregnancy and surrogacy; and d) The proposal on private agreements.

ASADIP participated, represented by Professors Claudia Lima and Nadia de Araujo, in the meeting of the Council on General Affairs and Policy where the project Protection of Tourists presented by Brazil and ASADIP was included in the agenda of the HCCH (March 24th and 26th)

 

ASADIP participated, through its Vice-President Paula All, to the opening of the new offices of the HCCH in Buenos Aires (November 25).

Also, the Representative for Latin America of the Hague Conference  participated in the Annual Conference of Panama this year.

 

 

Participation in the Working Group of the Latin American Judicial Summit


With the strong support of the enthusiastic member of the ASADIP Ignacio Goicoechea, Liaison Officer of the Hague Conference for Latin America, ASADIP will participate in April 2016 at the Working Group of the Latin American Judicial Summit on international legal cooperation. It is expected that the work being done by ASADIP on the subject will receive wide visibility there.


Other partnerships

 


ASADIP also cooperates with other organizations such as UNIDROIT which has included in the minutes of the meeting of the Governing Council of May this year the chance to explore the ASADIP possible cooperation on issues of international civil procedural law.

 

The Secretary General of UNIDROIT, Dr. Angelo Estrella-Faria, visited the headquarters of the ASADIP in Asuncion.

 

 

ASADIP has been actively involved in sessions of UNCITRAL working groups concerning online dispute resolution, arbitration and conciliation and secured transactions, with the presence of Alejandro Garro, Claudia Lima Marques, Roger Rubio and others members of the organization.

 

ASADIP also has partnerships with the Permanent Review Court of MERCOSUR and the Central American Court of Justice.

ASADIP Principles on Transnational Access to Justice

 

Under the leadership of Prof. Diego Fernandez Arroyo, and with the approval at the 2013 General Assembly in Asuncion, ASADIP intends to develop guiding principles for codifying efforts that will also serve as an interpretative tool for legal operators in the region.

 

This work will be guided by the growing importance of procedural issues in resolving the problems affecting international private law relations and its direct impact on the protection of fundamental human rights to access to justice.

 

The preliminary working paper was written by Diego Fernandez Arroyo, Alejandro Garro, Eduardo Vescovi, Claudia Martinez Madrid and Javier Ochoa.


Electronic Publications

Electronic journal of the American Association of Private International Law

 

Forthcoming. The idea of REASADIP is as part of the Private International Law Latin American tradition, to take into consideration the changes in the scientific and systematic conceptions of private international law as the situation in Latin America in the Americas, and both in the world at the present time. Contributors will be important jurists of Latin American and the world.

 

Notebooks ASADIP

 

ASADIP notebooks - Young researchers, it is an electronic academic publication ASADIP with international refereed aimed at young researchers up to 35 years old, whose main objective is to encourage and promote the generation of academic work according to the rules of peer review. The initiative aims to contribute to the editorial production of the ideas of beginners in research, so as to serve as a bridge for dialogue between different research related to private international law and related disciplines.

 

Model Program on Private International Law

 

Another project undertaken by the ASADIP is the Model Program on Private International Law for the region, for which results are expected for the conference of 2015. This is done with the collaboration of teachers Mirian Rodríguez and Eugenio Hernandez-Breton, both of Venezuela, based on the report presented at the Second Conference of ASADIP held in Mexico City in 2008, developed within the Teaching Commission, composed by professors María Blanca Noodt Taquela and Claudia Madrid, in which had been systematized the content of programs to study various private international law in mainland universities.

ASADIP counts already two years ago with its own headquarters in Asuncion. Its Administrative Secretariat, with support from CEDEP, is fully operational: information, assistance to members, preparation of meetings, support in publishing, operation of the website, correspondence, communication with international bodies, consultations universities, institutes and the general public.

The website includes valuable information on the Private International Law discipline, and it is one of the most complete and best accomplished existing in the world today.
